DMCA Copyright Policy

Repair Manual respects the intellectual property rights of others and expects users, customers, suppliers, and other parties to do the same.

In accordance with the Digital Millennium Copyright Act of 1998 (“DMCA”), including 17 U.S.C. § 512, Repair Manual will respond to properly submitted notices of alleged copyright infringement and may remove or disable access to material when appropriate.

Copyright Infringement Notice

If you believe that copyrighted material available through Repair Manual infringes a copyright that you own or are authorized to enforce, you may submit a written DMCA notice to our designated copyright contact.

A valid DMCA notice should include:

A physical or electronic signature of the copyright owner or a person authorized to act on the copyright owner’s behalf.
Identification of the copyrighted work claimed to have been infringed. If multiple copyrighted works are involved, you may provide a representative list of those works.
Identification of the material claimed to be infringing and sufficient information to allow us to locate the material, including the relevant product page, URL, listing, image, file, or other location where applicable.
Your name, mailing address, telephone number, and email address.
A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
A statement that the information contained in your notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the copyright owner.

To help us process your request efficiently, please include “DMCA Copyright Notice” in the subject line of your email.

Review and Removal of Material

Upon receiving a substantially compliant DMCA notice, Repair Manual may investigate the complaint and, where appropriate, remove or disable access to the material identified in the notice. We may also contact the person or party responsible for the affected material and provide them with information concerning the claim.

Submission of a DMCA notice does not automatically establish that copyright infringement has occurred. Repair Manual reserves the right to review the information provided and request additional information where reasonably necessary to identify the material or evaluate the notice.

Counter-Notification

If material has been removed or disabled as the result of a DMCA notice and you believe that the material was removed because of a mistake or misidentification, you may submit a written counter-notification.

A counter-notification should include:

Your physical or electronic signature.
Identification of the material that was removed or disabled and the location where the material appeared before it was removed or disabled.
A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as the result of mistake or misidentification.
Your name, address, and telephone number, together with the legally required consent to the jurisdiction of the appropriate United States Federal District Court and acceptance of service of process from the person who submitted the original DMCA notice or that person’s agent.

Counter-notifications should be sent using the same contact information listed above and should include “DMCA Counter-Notification” in the subject line.

Restoration of Material

When a valid counter-notification is received, Repair Manual may provide a copy to the party who submitted the original infringement notice. Where the requirements of the DMCA apply, removed material may be restored in accordance with the statutory process unless the original complaining party notifies us that it has filed an action seeking a court order relating to the disputed material.

Repeat Infringement

Where applicable, Repair Manual maintains a policy of taking appropriate action with respect to parties who repeatedly infringe the intellectual property rights of others. Depending on the circumstances, this may include restricting access, terminating accounts or services, removing material, or refusing further submissions.

Misrepresentation

Please do not submit false or misleading copyright claims. Under the DMCA, a person who knowingly materially misrepresents that material or activity is infringing, or that material was removed or disabled by mistake or misidentification, may be subject to liability.

Trademarks and Equipment Identification

Manufacturer names, equipment names, model numbers, trademarks, logos, and other product references appearing on Repair Manual may be used for identification and descriptive purposes. Unless expressly stated otherwise, Repair Manual is an independent business and is not the manufacturer of the equipment identified on the website.

Copyright complaints should relate specifically to copyright-protected material. Trademark, brand, contractual, ownership, or other legal concerns may be submitted separately to support@repairmanual.org.

Changes to This Policy

Repair Manual may update this DMCA Copyright Policy from time to time to reflect changes in our procedures, services, or applicable law. The version published on this page will be the current version.
